CIA 04 - MOTION TO SET ASIDE DEFAULT JUDGMENT AND ORDER. This form is used form in Michigan by a defendant in a civil infraction case to request that the court overturn a default judgment. This motion is typically filed within 14 days after the court issues the default judgment. The defendant provides reasons for missing the deadline to respond to the infraction or failing to appear at a hearing, explains their defense against the complaint, and attaches a cash bond equal to the amount of fines and costs stated in the judgment. The form allows the defendant to ask the court to set aside the judgment and schedule a hearing to review the request.
