COMPLAINT FOR ADMINISTRATIVE REVIEW. The Circuit Court of Madison County has jurisdiction to hear requests for administrative reviews of findings and decisions made by certain departments within Madison County government, various municipalities or other units of local government, electoral boards, state agencies, pension funds, and other administrative bodies as provided by law. The process for filing an administrative review commences upon the filing of an administrative review complaint with the Madison County Circuit Clerk’s office and paying the required fee. An administrative review complaint may be filed “pro-se” (without legal counsel) or you may choose to retain an attorney to handle this process for you. Given the complexity of administrative review maters you are strongly encouraged to seek the advice of an attorney. Once the complaint has been served upon the defendants, they will have time to file an answer or other responsive pleading. The administrative agency will file the record of its proceedings with its answer. The case will then be scheduled for a status conference during which the assigned judge will review the file, hear any preliminary issues, and then schedule a hearing date on which the Court will hear argument from all parties. After the final hearing, the Court will issue a decision either affirming or reversing the administrative agency. Please be advised that the process of filing and prosecuting an administrative review mater is very complex, with strict statutory requirements dictating the content of the complaint, the parties who must be named as defendants, and the timing for both filing the complaint and requesting that a summons be issued and served. While the Administrative Review Law applies to most cases, there may be other statutes (Election Code, Pension Code, etc.) specific to your case that may have different requirements.
