Description

SDSC CRM-277 - PETITION FOR RESENTENCING / REDUCTION TO MISDEMEANOR. This form is used in the Superior Court of California, County of San Diego by the defendant (referred to as the petitioner) to request the court to reconsider their felony conviction and reduce it to a misdemeanor, in accordance with Penal Code section 1170.18. The form requires the petitioner to provide their personal information, including full name, date of birth, and address. It also asks for details of the conviction, such as the specific felony offense(s) that have now been reclassified as misdemeanors. The petitioner must confirm that they have no prior convictions that would disqualify them from resentencing under Penal Code sections 667(e)(2)(C)(iv) or 290(c), and that they do not pose an unreasonable risk to public safety. The petitioner can indicate whether they are currently serving the sentence or if they have completed it. They then request the court to reduce the felony count(s) to misdemeanor(s) and resentence them accordingly. Additionally, the petitioner needs to provide a justification for the delayed filing of the petition if applicable. The form concludes with a declaration made under penalty of perjury, where the petitioner or their attorney must sign and date the document. Optional Form, Pen. Code, § 1170.18. www.FormsWorkflow.com
