CIV-380 - STIPULATION FOR COURT COMMISSIONER TO ACT AS TEMPORARY JUDGE FOR ALL PURPOSES. For a commissioner to act as a judge in a case, all parties must stipulate that he or she can act as a temporary judge. If any party does not stipulate, the case will be reassigned to a judge for all hearings. A commissioner’s authority to act as a judge with the parties’ consent comes from article VI, sections 21 and 22 of the California Constitution, and Code of Civil Procedure section 259(d).
