DWC-WCAB form 10208.3, DECLARATION OF READINESS TO PROCEED TO EXPEDITED HEARING (TRIAL) [Labor Code section 5502(b) ]. This form is used in the California workers' compensation system to request an expedited hearing or trial on a workers' compensation case. The form lists several issues that can be heard at the expedited hearing, including entitlement to medical treatment, entitlement to temporary disability, disputes over the establishment of a medical provider network (MPN), and disputes over compensation due to disagreements between employers and/or carriers. Under California Labor Code section 5502(b), an expedited hearing may be granted if the case involves a dispute over medical treatment or the need for medical treatment, and the disputed treatment is necessary to cure or relieve the effects of the injury. The Declarant, who is the party requesting the expedited hearing, must state under penalty of perjury that they have made specific, genuine, good faith efforts to resolve the dispute(s). By submitting this form, the Declarant is requesting that their case be set for an expedited hearing before a workers' compensation judge to resolve the disputed issue(s) as quickly as possible.
