Description

B2400B (Form B2400B) (12/15) MOTION FOR APPROVAL OF REAFFIRMATION AGREEMENT. This form is filed by a debtor with the bankruptcy court, requesting approval of a reaffirmation agreement that the debtor has entered into with a creditor. A reaffirmation agreement is a legal contract between a debtor and a creditor in which the debtor agrees to pay all or a portion of the debt owed to the creditor, even though the debt would otherwise be discharged in bankruptcy. The reaffirmation agreement allows the debtor to keep the property secured by the debt, such as a car or a home, but it also creates a new legal obligation that is not dischargeable in bankruptcy. The Motion for Approval of Reaffirmation Agreement must include a statement from the debtor affirming that they believe the reaffirmation agreement is in their best interest and that they are not represented by an attorney in connection with the reaffirmation agreement. The debtor must also provide any additional relevant reasons why the court should approve the agreement. The court will review the Motion for Approval of Reaffirmation Agreement and determine whether the reaffirmation agreement is in the debtor's best interest and whether the debtor has the ability to make the required payments.
