The Court, having received evidence, now finds that Plaintiff is entitled to recover from the earnings of the Defendant the amount required to satisfy the judgment with costs, interest, and fees until the judgment is fully paid and satisfied. The Garnishee Defendant is entitled to a fee of 3% of the amount to be collected or $12, whichever is greater, one-half of such fee being paid by the Plaintiff (Judgment Creditor) and one half by the Defendant (Judgment Debtor), computed as follows: $______________ (a) Total amount to be collected before adjustment for fee (judgment plus costs and interest to date); $______________ (b) 3% of (a) or $12.00, whichever is greater to be kept by Garnishee Defendant (Employer) as fee; $______________ (c) One-half of fee to be contributed by Defendant (Judgment Debtor): 50% of (b); $______________ (d) Amount to be collected from wages of Defendant (Judgment Debtor): (a) plus (c); $______________ (e) Amount to be paid to Clerk by Garnishee Defendant (Employer): (d) minus (b). IT IS HEREBY ORDERED that Garnishee Defendant (Employer) pay at least monthly to the Clerk of Hamilton County the following amount: the amount by which Defendant=s (Judgment Debtor=s) weekly disposable earnings exceed 30 times the current minimum wage; OR 25% of Defendant=s (Judgment Debtor=s) disposable earnings, whichever is less, until the amount set forth above on line (e) has been paid to the Clerk and the fee on line (b) has been collected. Disposable earnings means income remaining after deductions for federal and state income tax and Social Security tax. The Court orders the Garnishee Defendant (Employer) to send payments to Clerk of Hamilton County, One Hamilton County Square, Suite 106, Noblesville, IN 46060, and to include this cause number with each payment. Final garnishment orders take priority in the order in which they are received except that deductions for child support shall be considered garnishments and shall take priority over all other garnishments when received. Deductions for more than one garnishment may be made, but only up to the maximum deduction stated above.
