DEFENDANT: ORDER ON MOTION FOR SEALING OF ARREST RECORD AND COURT FILE (Penal Code Section § 851.90) Case Number: On the motion of the Defendant, and after due consideration and review of the moving papers, the District Attorney's response and records in this case, the Court hereby ORDERS that: Defendant's motion is GRANTED. All law enforcement agency records related to and concerning the Defendant's detention and arrest in this case, and all related court files in this case, must be SEALED, effective immediately, pursuant to and consistent with Penal Code § 851.90. Except as noted below, Defendant is free to state in response to any question concerning his or her prior criminal record that he or she was NOT arrested or granted drug diversion or deferred entry of judgment as it relates to this case. NOTE TO DEFENDANT: Notwithstanding your successful completion of drug diversion or deferred entry of judgment, this sealing order does NOT relieve you of the obligation to disclose your drug arrest in response to any direct question contained in any application or questionnaire for a peace officer position as defined in Penal Code§ 830. Furthermore, the arrest upon which the drug case is based shall be disclosed by the Department of Justice or the Court in which the matter was heard in response to any subsequent inquiry by a district attorney, court, probation department, or your attorney concerning your eligibility for drug diversion or deferred entry of judgment in the future. Notwithstanding this order, the Department of Justice may continue to maintain and disseminate any records or documents received or maintained as otherwise authorized by law.
