Paragraphs 3.1, 3.2, 3.5, 3.6 I. Hearing 1.1 After proper notice, a disposition hearing was held on (Date) to consider the disposition following approval of a Child in Need of Services (CHINS) Petition regarding the above-named child. 1.2 Persons appearing were: Child Child222s Lawyer Parent Parent222s Lawyer DCYF Case Worker State222s Lawyer Probation Counselor Other 1.3 Testimony was taken. II. Findings The court finds: 2.1 Child222s Indian status: Does not apply because the petition was not filed by Department of Children, Youth, and Families. There is not a reason to know the child is an Indian child as defined in RCW 13.38.040 and 25 U.S.C. 247 1903(4), and the Federal and Washington State Indian Child Welfare Acts do not apply to this proceeding. American LegalNet, Inc. www.FormsWorkFlow.com Order of Disposition (CHINS) (ORD) - Page 2 of 3 WPF JU 05.0400 (07/2018) - RCW 13.32A.179 2.2 A fact finding hearing was held and the CHINS petition was approved. 2.3 The court has received the disposition recommendations from all parties, including the Department of Children, Youth, and Families. 2.4 An at-risk-youth petition has been filed by the parents and consolidated with this action. 2.5 The court finds by clear, cogent and convincing evidence that: out-of-home placement is in the child222s best interest as it is contrary to the welfare of the child to remain in or be returned to the child222s home; it is in the child222s interest to be placed in foster care; the parents have not requested out-of-home placement; the parents have not exercised any other right listed in RCW 13.32A.160(1)(e); the child has made reasonable efforts to resolve the problem that led to the filing of the petition; the filing of the petition has been resolved by delivery of services to the family during continued placement of the child in the parental home; reasonable efforts have been made to prevent or eliminate the need for removal of the child from the child222s home and to make it possible for the child to return home; and a suitable out-of-home placement resource is available. 2.6 The parents have requested out-of-home placement. 2.7 There no longer is a reason to approve the CHINS petition. III. Order The court orders that: 3.1 The petition is dismissed, and the child shall return or remain at home. The Department of Children, Youth, and Families shall submit a dispositional plan. The at-risk-youth petition filed by the parents and consolidated with this proceeding is approved and the CHINS petition is dismissed. The Department of Children, Youth, and Families shall review the matter for purposes of filing a dependency action under Chapter 13.34 RCW. The child shall be placed or remain for a period not to exceed 90 days from the date of this order, in out-of-home placement, as follows: With Name: Telephone: Address: The Department of Children, Youth, and Families for placement in foster care.
