Superior Court of California County of San Francisco ABOUT RENEWAL OF JUDGMENT - CCP 683. 020 ­ 683.220 RENEWAL OF JUDGMENT Money judgments automatically expire after 10 years. Once a judgment expires, it is no longer enforceable and the judgment creditor is not able to collect any unpaid judgment amounts. To prevent this from happening, the judgment creditor must renew the judgment BEFORE the 10 years run out. The judgment may be renewed for another 10 years, allowing the judgment creditor to continue collection efforts. When the judgment is renewed, any interest accrued up to that point is added to the principle amount owed. The judgment creditor is entitled to interest on the principle (which now includes the accrued interest) which compounds the interest. Once the Judgment expires, it cannot be renewed without a Court Order TERMS TO KNOW: Judgment debtor: the person owing or defaulted on payment of judgment Judgment creditor: the person who is owed the money Method of service: The judgment creditor shall serve a Notice of Renewal of the Judgment on the judgment debtor. Service shall be made personally or by first-class mail and proof of service shall be filed with the court clerk. NOTICE OF RENEWAL OF JUDGMENT The notice shall be in a form prescribed by the Judicial Council ­EJ-195 and shall inform the judgment debtor that the judgment debtor has 30 days within which to make a motion to vacate or modify the renewal. PROOF OF SERVICE Until proof of service is filed, no writ may be issued, nor may any enforcement proceedings be commenced to enforce the judgment, except to the extent that the judgment would be enforceable had it not been renewed.
