JUDGMENT FOR POSSESSION (UNLAWFUL DETAINER). This form is used in Duval County, Florida, to grant a property owner legal possession of a premises from which a defendant is unlawfully occupying without a lease or other legal right. This form is issued after the court has reviewed the plaintiff’s complaint for unlawful detainer and determined that the defendant was properly served with notice and failed to contest the allegations or that sufficient testimony or affidavits were provided in support of the claim. The judgment orders that the plaintiff recover possession of the specified premises and directs the court clerk to issue a Writ of Possession to the sheriff, commanding the removal of the defendant from the property. The order may also include court costs owed by the defendant, along with an interest rate as provided by Florida law. Depending on the court’s ruling, the writ of possession may be issued immediately or after a waiting period of ten days.
