Request For Late Reset Of Mediation Conference

REQUEST FOR LATE RESET OF MEDIATION CONFERENCE. To assure the timely and efficient resolution of Workers’ Compensation disputes, NMSA §52-5-5(C) requires, following a mediation conference, that the Administration issue a recommended resolution within (60) days of the filing of a Complaint. NMAC 11.4.4.10(C)(2) allows the parties to reschedule a mediation conference to occur within 75 days of filing the Complaint thereby stipulating that all parties are waiving the 60-day statutory requirement. This form should only be used if you are attempting to reschedule within (5) days of a scheduled conference or seeking a conference beyond the 75-day rule. Otherwise utilize the Electronic Case Filing “ECF” system to reschedule online. For administrative efficiency the re-scheduling of mediation conferences within (5) days of a schedule conference or efforts to reschedule beyond the 75-day rule are highly discouraged and will only be approved by the WCA Mediation Bureau Chief upon a showing of good cause.
