Description
PEMH 1027 - PETITION AND ORDER FOR DISCOVERY ESTATE NOT EXCEEDING $15,000.00. This form is used in the State of Michigan, in the Probate Court of Oakland County to request discovery of information regarding the estate of a deceased individual, provided that the total value of the decedent's property remaining after payment of funeral and burial expenses does not exceed $15,000, as adjusted for cost of living based on the year of death. The form requires the petitioner to provide information about the deceased, including the date of death, residency, and property value. The petitioner must also list the heirs' names, ages, relationships, and addresses. Furthermore, the petitioner can request that any financial institution be ordered to reveal whether the decedent had any accounts with them and the balances in those accounts at the time of death and the present. The completed form is then submitted to the court, and if approved, a certified copy of the order is presented to financial institutions to gather the requested information about the decedent's accounts. This process is used when the value of the deceased individual's estate is relatively small and falls below the specified threshold. MCL 700.1210, MCL 700.3982. www.FormsWorkflow.com
