Description

PC 551 - PETITION AND ORDER TO OPEN SAFE-DEPOSIT BOX TO LOCATE WILL OR BURIAL DEED. This form is used in the Probate Court of Michigan for the purpose of petitioning the court to open a safe-deposit box in order to locate the decedent's will or burial deed. It is typically filed by someone who has an interest in the decedent's estate, such as an heir or devisee. The petitioner provides information about the decedent, including their name, date of death, and domicile. The petitioner also identifies the financial institution and safe-deposit box number where the box is located. The petition requests the court to issue an order directing the institution to allow the petitioner to examine the contents of the safe-deposit box in the presence of an authorized employee of the institution. The purpose of this examination is to locate and remove only the decedent's will and/or a deed to a burial plot. If the petition is granted, the court orders the institution to permit the examination and specifies that only the will or burial deed should be removed and delivered to the probate register or deputy register of the court. After the examination, a Safe-Deposit Box Certificate and Receipt (Form PC 552) must be filed with the court to document the findings. If no safe-deposit box is found, the petitioner must also file a PC 552 indicating that no box was located. Approved, SCAO. MCL 700.2517. www.FormsWorkflow.com
