Description
DIVORCE FILE REQUEST. This form is used by the Niagara County Clerk's Office in Lockport, New York. The form outlines the procedures for requesting copies of documents related to a divorce proceeding from the county clerk's office. According to Section 235 of the Domestic Relations Law, the county clerk's office can only provide copies of divorce documents to the parties involved in the divorce and their attorneys of record at the time of the proceeding. The form specifies that copies of documents will be provided to the party indicated below after they have shown satisfactory identification in person or signed the statement on the form, which must be notarized. The requesting party is required to include a self-addressed, stamped envelope and payment for the processing/certification fees. The fees are outlined on the form, with charges based on the number of pages and whether certification is requested. If a person who is not a party to the proceeding wishes to obtain information, they may request a Certificate of Dissolution, which states only the party names and the date of dissolution. There is a separate fee specified for obtaining this document. The form provides two options for the requester: one for the party to the divorce and another for the attorney representing one of the parties. If the requesting attorney is different from the attorney of record, proof of representation must be provided. The form includes a notary section where the requester's signature must be notarized, affirming that they are a party to the divorce or an attorney representing one of the parties. www.FormsWorkflow.com
