SC40 - PETITION SMALL CLAIMS COURT. This form is used in Missouri by a plaintiff to initiate a small claims court case against a defendant. The plaintiff provides information about themselves, the defendant, and the nature of the claim, including the amount of money being sought. The plaintiff also understands that, should he/she be successful in this action and obtain judgment, and if Defendant does not appeal within ten days, this judgment becomes final. Plaintiff cannot commence another action involving the same parties and issues.
