Description
DEFENDANT’S WAIVER OF APPEARANCE. This form is used in the United States District Court for the Northern District of Georgia. It is employed when a defendant in a criminal case voluntarily waives their right to be physically present in open court during their arraignment. In the arraignment process, the defendant is informed of the charges against them, and typically, the indictment is read to them in court. By signing this waiver, the defendant acknowledges that they have been advised of their right to be present during the arraignment, as guaranteed by the Sixth Amendment to the U.S. Constitution and Federal Rules of Criminal Procedure (Rules 10 and 43). The defendant confirms that they have discussed the charges with their attorney, understand the nature of the offenses, and voluntarily waive their right to appear at the arraignment. Instead, they choose to enter a plea of "NOT GUILTY" to the indictment without a formal arraignment proceeding. www.FormsWorkflow.com
