USCA 61 - CONFIDENTIAL REQUEST TO ENTER APPELLATE MEDIATION PROGRAM. The United States Court of Appeals for the District of Columbia Circuit has established an Appellate Mediation Program to encourage the settlement of appellate cases. Cases are selected for mediation by the Chief Circuit Mediator and the Legal Division of the Clerk's Office. Cases selected for mediation are mediated by volunteers who are selected by the Court and trained by the Mediation Program. These volunteers are distinguished members of the bar, experienced attorney-mediators in private practice, and members of local law school faculties. All mediation sessions are confidential and do not alter the briefing or oral argument schedule unless the parties request a change. Information that is provided to the mediator during the course of the mediation is not made available to the judges and does not become part of the record on appeal. Any party may make a confidential request that their case be considered for mediation by completing the "Request to Enter Appellate Mediation Program" on the preceding page and emailing it to the Mediation Program.
