ILLINOIS REAL PROPERTY TRANSFER ON DEATH INSTRUMENT (TODI) PURSUANT TO § 755 ILCS 27/1 ET.SEQ. This form allows a property owner to designate beneficiaries who will inherit real estate upon the owner's death without the need for probate. The form includes the owner's name, address, and legal property description, along with the names of the designated beneficiaries and any contingency beneficiaries. The owner must be of sound mind and voluntarily sign the document in the presence of witnesses and a notary public. The TODI specifies whether multiple beneficiaries will hold the property as joint tenants with the right of survivorship or tenants in common without survivorship rights. This document is exempt from certain transfer taxes and is provided as a courtesy by the Cook County Clerk’s Office.
