Description
CCLF‐CRS‐001 - MOTION TO RECALL ORDER FOR ARREST AND SET ASIDE BOND FORFEITURE. This form is used in Cumberland County, North Carolina, to request the recall of an Order for Arrest (OFA) and to set aside a Bond Forfeiture issued against a defendant who failed to appear in Superior Court. The attorney for the defendant completes the form, providing reasons for the failure to appear, and submits it for consideration. The District Attorney's office indicates whether it opposes or supports the motion. A Superior Court Judge then reviews the request and may either recall the Order for Arrest, set aside the bond forfeiture, and reschedule the case on the court calendar, or deny the motion. The attorney is responsible for distributing copies of the approved recall order to relevant parties, including the Clerk of Superior Court and the appropriate arresting agency, to prevent the defendant's arrest. www.FormsWorkflow.com
