AOC-851 - AFFIDAVIT OF WAIVER OF FORMAL SETTLEMENT. To be used with AOC-850, Informal Final Settlement Affidavit and Motion, when there is more than one beneficiary. This form is used in Kentucky probate court for the settlement of an estate. It is signed by the beneficiaries of the estate, who, under oath, consent to an informal settlement process and waive the formal requirements for settling fiduciaries' accounts under Kentucky law (KRS Chapter 395). NOTICE TO JUDGE: If one or more beneficiaries is under a disability, you may allow the fling of an Informal Settlement if you are of the opinion the best interests of the person under the disability would be served.
