P-3.036 - COMMISSION. This form is used in the Circuit Court of Florida for the purpose of taking the oath of a subscribing and attesting witness to a will when the witness cannot appear in court. The circuit judge appoints a commissioner to administer the oath to the witness, who attests to the authenticity and proper execution of the will. The commissioner is directed to have the witness swear to the form provided, certify the oath, and return the completed documents (including the commission, a copy of the will, the oath of the witness, and the certificate of the commissioner) to the court.
