RI-PR080 - PETITION FOR SMALL ESTATE SET-ASIDE. This form is used in California courts to request a Small Estate Set-Aside under Probate Code § 6600. It allows a petitioner, such as a surviving spouse, registered domestic partner, minor child, or other interested party, to request that an entire estate valued at $85,900 or less (after liens, encumbrances, and probate homestead interests) be set aside to them without formal estate administration. The petitioner must detail the estate's value, any outstanding liabilities or expenses, and list the heirs or devisees entitled to notice. If the decedent left a will, it must be attached.
