Description

APPELLATE SETTLEMENT. This form is used in the Court of Appeal, Fourth Appellate District, State of California, to formally request the initiation of settlement procedures in a pending appeal. This form must be signed by counsel of record for a party to the appeal and signifies their agreement to comply with the court’s appellate settlement guidelines and participate in good faith. The form allows parties to request a Settlement Justice, who may be a sitting appellate justice or another qualified individual. If a non-sitting justice is requested, the parties agree to pay reasonable compensation for their services. Upon approval, the Presiding Justice appoints a Settlement Justice with the authority to conduct hearings, require documentation, and oversee the settlement process. The attached guidelines outline the settlement procedures, specifying that requests can be filed at any time up to 30 days after the final briefs are submitted. The settlement process typically does not delay the appellate briefing schedule. While the parties may suggest a Settlement Justice, the final selection remains at the discretion of the Presiding Justice, and the court reserves the right to decline settlement procedures in certain cases. www.FormsWorkflow.com
