Description

JD-JM-58 - MOTION/ORDER OF TEMPORARY CUSTODY/ ORDER TO APPEAR. This form is used in Connecticut Superior Court juvenile matters to request an emergency order granting temporary custody of a child. This form is typically filed by the Department of Children and Families (DCF) or another petitioner when there is reasonable cause to believe that a child is suffering from serious illness, injury, or is in immediate physical danger. The motion requests the court to issue an ex parte (emergency) order transferring custody of the child to a state agency, a relative, or another suitable guardian to ensure the child’s safety. The form also serves as a summons, requiring the child's parents, guardians, or other relevant parties to appear in court for a hearing to determine whether the temporary custody order should be upheld pending further legal proceedings. The form includes a section for the court to document its findings, including whether reasonable efforts were made to prevent the child’s removal from their home. If the motion is granted, the child remains in temporary custody until the court determines a more permanent resolution. C.G.S. § 46b-129 (b), P.A. 21-15; P.B. 33a-6. www.FormsWorkflow.com
