10.5 IMPROPER EXHIBITION OF WEAPON 790.10 , Fla. Stat. To prove the crime of [crime charged], the State must prove the following three elements beyond a reasonable doubt: 1. [Name of defendant] had or carried [weapon alleged]. 2. [Name of defendant] exhibited [weapon alleged] in a rude, careless, angry or threatening manner. 3. [Name of defendant] did so in the presence of one or more persons. If you find that [name of defendant] committed [crime charged] in necessary self-defense, you must find the defendant not guilty.
