3.8(f) TAPE RECORDING - TRANSCRIPT CHOOSE ONE OF THE FOLLOWING: This transcript is not admitted and will not be admitted into evidence. The evidence is what is on the tape recording. If there is a conflict between what the transcript says and what you hear the tape says, the evidence is the tape, not the transcript and if you hear a conflict, what is on the tape is what the evidence is. OR As you have heard, Exhibit ____, has been identified as a typewritten transcript [ and partial translation from Spanish into English] of the oral conversation which can be heard on the tape recording received in evidence as Exhibit ____. [The transcript also purports to identify the speakers engaged in such conversation.] I have admitted the transcript for the limited and secondary purpose of aiding you in following the content of the conversation as you listen to the tape recording, [ particularly those portions spoken in Spanish,] [and also to aid you in identifying the speakers.] However, you are specifically instructed that whether the transcript correctly or incorrectly reflects the content of the conversation [or the identity of the speakersor the identity of the speakersentirely for you to determine based upon your own examination of the transcript in relation to your heari the png of the tape recording itself asrimary evidence of its own contents; and, if you should determine that the transcript is in any respect incorrect or unreliable, you should disregard it to that extent.
