Description
DISPOSITION OF PERSONAL PROPERTY WITHOUT ADMINISTRATION. This form is used in Florida, pursuant to Florida Statute 735.301 and Florida Probate Rule 5.420 and allows an individual (the petitioner) to request the distribution of a deceased person's personal property without the need for full probate administration, under certain conditions. The petition can be filed if the decedent’s estate consists only of exempt property and non-exempt property valued at or below the sum of preferred funeral expenses and reasonable medical expenses incurred in the last 60 days of the decedent's life. The form requires the petitioner to provide details about the decedent, including their death date and residence, the names of beneficiaries, a description of assets (exempt and non-exempt), and any funeral or medical expenses. It must also include documents such as the death certificate, funeral receipts, medical records, and a copy of the decedent’s will (if applicable). The petition must be signed by a relative of the deceased, and certain assets, such as real estate or significant bank accounts, may disqualify the filing from proceeding under this process. If the estate involves assets exceeding the allowed limits, legal advice is recommended, as a full probate may be necessary. www.FormsWorkflow.com
