16.221 Contracts; Accident; Definition In some circumstances, a party to a contract may be relieved from the duties and responsibilities of the contract upon the happening of an accident. The accident, to be a sufficient occurrence, must meet the following three requirements: a. b. c. It must not be the result of the negligence or misconduct of the party seeking relief; It must not have been anticipated by the parties at the time the contract was entered into; and The result of the accident must be that one of the parties has gained an undue advantage over the other in a court of law.
