CASE NUMBER I understand that I have a right to a confidential hearing--that is, a hearing which is closed to the public. I understand that if I give up my right to a confidential hearing, the court will hear my case today in the presence of other minors who are also having their cases heard, as well as any adults who have come to court with them. I understand that if I do not give up my right to a confidential hearing, the court will either hear my case in private at the end of the group sessions or will set a future time and date to hear my case in private, and I will be ordered to return to court for that hearing. I voluntarily give up my right to a confidential hearing. ACKNOWLEDGMENT OF RIGHTS 1. I understand that if I am 18 years old or older today, I may give up the benefits of having my case handled in Juvenile Court and I may ask to be prosecuted as an adult instead, with all the legal rights of an adult. If I choose to be prosecuted as an adult and I am being charged with a misdemeanor, I will have the right to a jury trial. I am 18 years old or older, and I wish to be prosecuted as an adult rather than having my case handled in Juvenile Court. I understand that I have a right to hire a lawyer to represent me at all court hearings. I understand that if I am charged with a misdemeanor, the court will appoint a lawyer to represent me if I ask for a lawyer and I cannot afford one. If after a hearing the court decides that we can afford to pay, my parents or guardian and I will have to pay San Diego County for all or part of the cost of the lawyer's services. I understand that if I am charged with certain Vehicle Code infractions, I may deny the charge(s) and have a trial by written declaration instead of by a personal court appearance (Veh. Code § 40902). I understand that if I admit the charge(s) against me, I will be giving up the following constitutional rights: a. The right to a speedy trial. b. The right to present evidence. c. The right to confront witnesses and ask them questions. d. The right to have the court summon witnesses for me at no cost to me. e. The right to remain silent and not to incriminate myself.
