MOTION FOR ALTERNATE METHOD OF PROOF OF WILL BY DEPOSITION OF SUBSCRIBING WITNESS. This form is used to request the probate court's permission to use an alternate method of proving a will, specifically by deposition of a subscribing witness. If the witnesses to the will are either nonresidents of the county or unable to attend the court hearing, the applicant can file this motion to allow the will to be proved by the sworn testimony of one of the witnesses, either through a written or oral deposition.
