Description
SMALL ESTATE AFFIDAVIT. This form is used in Texas to simplify the probate process for estates that meet specific criteria. It allows heirs to distribute the decedent's assets without going through formal probate proceedings. The form requires information about the decedent, including the date and place of death, confirmation that there was no will, and that the estate’s value does not exceed $75,000, excluding exempt property like a homestead. It also requires details about the decedent's family history, such as their marital status and children. A list of assets and liabilities must be provided, along with their values. The heirs must sign the affidavit, swearing that the information is accurate. Two disinterested witnesses must also sign, attesting that they have no personal interest in the estate and that the facts are correct.
