FORECLOSURE ACTION SURPLUS MONIES FORM. This form is used in New York State Supreme or County Court to document and report any surplus funds resulting from the foreclosure sale of a mortgaged property. After the property is sold, the form is filled out by the Referee overseeing the sale, the Plaintiff’s representative, and, if applicable, the Purchaser. The Referee calculates whether there is any surplus money remaining after the mortgage debt and other associated costs are paid. If surplus funds exist, proof of their deposit with the appropriate financial authority is required.
