D-31d - NOTICE OF INTENTION TO CLOSE CLAIM OF LESS THAN $800 IN MEDICAL BENEFITS IN 12 MONTHS- PERMANENT PARTIAL DISABILITY EVALUATION SCHEDULED (Pursuant to NRS 616C.235(2) and (3)). This is a formal notice issued by a workers’ compensation insurer in Nevada. This notice informs an injured worker that their workers’ compensation claim is being closed because the total medical benefits paid were less than $800 within the first 12 months of the claim being opened, as permitted under NRS 616C.235(2). Additionally, the notice states that the worker has been scheduled for a Permanent Partial Disability (PPD) evaluation under NRS 616C.490. This evaluation determines whether the worker has any lasting impairment due to the injury and if they qualify for a PPD compensation award. The notice also outlines the worker's appeal rights under NRS 616C.305 and NRS 616C.315-616C.385. If the worker disagrees with the claim closure, they must file an appeal within 70 days with the Nevada Department of Administration, Hearings Division. If no appeal is filed, or if the appeal is unsuccessful, the claim cannot be reopened unless the worker’s condition worsens and meets the reopening requirements under NRS 616C.390. To reopen the claim, the worker must submit a written request, along with a doctor’s report stating that their condition has deteriorated since the claim closure and requires additional medical care.
