Description

EDC 003-727 - ENTRY OF DEFAULT AND ORDER RE: DEFAULT JUDGMENT PROCEDURES. This form is to be used for a single defendant only. If you have multiple defendants, please submit a separate form for each. This form is used in adversary proceedings within a United States Bankruptcy Court case when a defendant fails to respond, plead, or otherwise defend themselves as required by law. This document serves as an official entry of default against the defendant under Federal Rule of Civil Procedure 55, as incorporated by Federal Rule of Bankruptcy Procedure 7055. Once default is entered, the plaintiff must apply for a default judgment within 30 days, following specific procedures outlined in the order. Depending on the court’s requirements, the plaintiff may need to schedule a "prove-up" hearing, submit declarations or affidavits proving liability, or provide additional documentation verifying the service address used for the defendant. If the plaintiff fails to comply with the order, they may face sanctions, including the potential dismissal of the adversary proceeding. www.FormsWorkflow.com
