Description

22.060 Condonation The defendant claims that any fault or misconduct on his/her part has been condoned or forgiven by the plaintiff. Condonation is forgiveness, either express or implied by a spouse, of breach of marital duty on the part of the other spouse, with the implied condition that the offense shall not be repeated. New acts constituting grounds for divorce after condonation will revive the grounds of divorce that took place before the condonation. (Note: Above not applicable in irretrievably broken cases, O.C.G.A. §19-5-3(13) and cases cited.) Phinizy v. Phinizy, 154 Ga. 199 (1922) Morris v. Morris, 202 Ga. 431 (1947) Odom v. Odom, 36 Ga. 286 (1867)
