DEU Form 105, APPORTIONMENT. This form is used by the California Department of Industrial Relations' Division of Workers' Compensation to apportion disability benefits between a pre-existing medical condition or disability and a work-related injury. Apportionment is the process of dividing responsibility for a worker's disability between a pre-existing condition and a work-related injury. The DEU Form 105 is used by the workers' compensation insurance carrier or the employer to provide information about the worker's pre-existing medical conditions or disabilities. This information is used to determine the percentage of disability that is directly related to the work-related injury and the percentage that is related to the pre-existing condition. The DEU Form 105 requires the employer or the workers' compensation insurance carrier to provide information about the worker's prior medical history and the medical history related to the current injury. The form is used to identify any pre-existing medical conditions or disabilities that may have contributed to the worker's current disability. Once the information is provided, the workers' compensation judge or the Disability Evaluation Unit (DEU) will review the information and make a determination of apportionment.
