ORAL ARGUMENT STATEMENT (Local Rule 34.1(a)). This form is used in the United States Court of Appeals for the Second Circuit to request or decline oral argument in an appeal case. Parties involved in the appeal must file this form within 14 days after the last appellee brief is filed. The form allows the party to indicate whether they want oral argument, want oral argument only if another party does, or do not want oral argument. If oral argument is requested, the form requires the name of the attorney who will argue and any dates of unavailability.
