Alternative Dispute Resolution (ADR) Attorney Certification (Commercial Division)

ALTERNATIVE DISPUTE RESOLUTION ("ADR") ATTORNEY CERTIFICATION. This form is used in the Supreme Court of the State of New York, Commercial Division. The form is submitted by an attorney representing a party in the case and certifies that they have discussed ADR options with their client and whether their client is willing to engage in ADR to aid in settlement. The attorney indicates whether their client wishes to jointly engage an ADR provider at an appropriate time for settlement or not. The form also requires the attorney to select applicable categories that describe the nature of the case involving ongoing business or personal relationships, employment agreements, commercial insurance coverage, construction litigation, etc. The certification must be served and filed with the court at the time of the Preliminary Conference and each subsequent Compliance or Status Conference.
