Form 1340 - APPLICATION FOR PAYMENT OF UNCLAIMED FUNDS. This form is used in the United States Bankruptcy Court for the Eastern District of Virginia when a claimant seeks to recover unclaimed funds that have been deposited with the court. These funds typically arise when a creditor, debtor, or other entity entitled to payment from a bankruptcy case fails to receive or cash a disbursement, and the money is subsequently held by the court. The applicant must provide detailed information regarding the claim, including the amount of funds requested, claimant’s contact information, and a history of the claim from the filing of the proof of claim to the present. The applicant must indicate the basis for their entitlement to the funds, whether as the original owner of record, a successor claimant, an attorney representing the claimant, or a representative of a deceased claimant’s estate.
