AOC-G-250 - SERVICEMEMBERS CIVIL RELIEF ACT DECLARATION. This form is used in North Carolina to verify the military status of a defendant in a civil case. Before a court can enter a default judgment against a defendant who has not appeared, the plaintiff must confirm whether the defendant is in active military service. This requirement stems from the Servicemembers Civil Relief Act (SCRA), which protects service members from legal proceedings that could negatively affect them while they are on active duty. In this form, the declarant (usually the plaintiff) attests, under penalty of perjury, to the defendant’s military status, either by personal knowledge or through verification via the Department of Defense’s SCRA website. If it’s determined that the defendant is in active service, the court must appoint an attorney to represent the defendant before proceeding.
