Description

DR-705 - MOTION TO CHANGE PARENTING PLAN (Custody) OR CHILD SUPPORT. This form is used in the Superior Court of Alaska when a parent seeks to modify an existing custody or child support order. This form allows a parent to request changes to the parenting plan, including custody and visitation schedules, when there has been a substantial change in circumstances that affects the child’s best interests. The motion also enables a parent to request modifications to child support payments if there has been a significant and long-term change in income, a shift in custody arrangements, or changes in the availability or cost of medical insurance for the child. The form requires detailed information about both parents, including their contact details, employment history, and any other legal cases involving the child. It also includes sections for listing the affected children and specifying how the current parenting plan differs from the original court order. If the request involves a change in custody, the court will consider whether child support should also be adjusted accordingly. Supporting documentation, such as financial records, custody agreements, and medical expense statements, must be attached to justify the requested changes. Additionally, the motion outlines options for income withholding in child support payments, with exceptions allowed under specific circumstances. Once completed, the motion must be filed with the court and served to the other parent and, if applicable, their attorney. A Certificate of Service is required to confirm that all necessary documents were provided. If the filing fee presents a hardship, the parent may request a fee waiver. AS 25.24.150.
