Form MC 37 - ORDER OF POSSESSION PENDING JUDGMENT CLAIM AND DELIVERY. This form is used in Michigan courts in claim and delivery cases to determine the temporary possession of property while the case is still pending. This form is issued when a plaintiff seeks immediate possession of property that is allegedly wrongfully held by the defendant. The court may either deny the request for possession or grant it with specific conditions. If possession is granted, the defendant may be required to retain the property without damaging or disposing of it, or the sheriff or court officer may be ordered to seize the property and deliver it to the plaintiff. The form may also require the posting of a penalty bond by either party to ensure compliance with the court’s orders and protect against wrongful possession claims. The form includes sections for law enforcement to document service of the order, the seizure and delivery of the property, or the inability to locate the defendant or property.
