Form MC 35 - COMPLAINT CLAIM AND DELIVERY. This form is used in Michigan courts when a plaintiff seeks to recover possession of specific personal property that they are lawfully entitled to but is being wrongfully held by the defendant. This legal action allows the plaintiff to request the return of the property or, if return is not possible, monetary compensation for its value. The form requires a description of the property, its estimated value, and the legal basis for the plaintiff’s claim. If the claim is based on a security agreement, the plaintiff may also seek repayment of a debt. The plaintiff can request damages if the defendant’s unlawful possession has caused financial harm.
