Description
JD-HM-32 - SUMMONS SUMMARY PROCESS (EVICTION). This form is used in Connecticut to initiate an eviction lawsuit, formally notifying a tenant that their landlord is seeking possession of the rental property. Type or print legibly. If you are a self-represented party, this form must be signed by a clerk of the court. If there is more than one defendant, make a copy of the summons for each additional defendant. Each copy of the summons must show who signed the summons and when it was signed. Also, if there are more than two plaintiffs or four defendants, complete the Civil Summons Continuation of Parties (form JD-CV-2) and attach it to the original and all copies of the complaint. Attach the summons to the complaint, and attach a copy of the summons to each copy of the complaint, which outlines the legal grounds for the eviction, such as nonpayment of rent, lease violations, or expiration of a lease term. The summons directs the tenant (defendant) to appear in court and respond to the lawsuit by filing an Appearance (JD-CL-12) form by the second day after the Return Date specified on the summons. If the tenant fails to file an appearance or respond, the court may enter a default judgment, allowing the landlord to proceed with eviction. The form also provides important information for tenants, including their right to file an Answer (JD-HM-5) to contest the eviction and where to obtain legal resources. It includes a Notice to Occupants Not Named on the Summons, informing any unnamed individuals residing in the property that they can file a Claim of Exemption (JD-HM-3) if they believe they have a right to stay. The landlord or their attorney is responsible for ensuring the summons and complaint are properly served on the tenant. After service has been made by a proper officer, file the original papers and the officer's return with the clerk of court.
