Description

MC 288 - ORDER TO REMIT PRISONER FUNDS FOR FINES, COSTS, AND ASSESSMENTS. This form is used in the State of Michigan. The order is directed towards prisoners who owe a balance of fines, costs, and assessments as ordered in the judgment of sentence or other court order. The order instructs the Department of Corrections to collect a specified percentage of the funds received by the prisoner over $50.00 each month as payment toward the obligation. The form also states that if the amount withheld at any one time is $100.00 or less, the Department of Corrections will continue collecting funds from the prisoner's trust account until the accumulated amount exceeds $100.00. At that point, the Department of Corrections will remit the amount to the court. The withdrawal and remittance of funds will continue until the obligation is paid in full. If the prisoner transfers to a facility without a trust account, or if the prisoner is paroled, discharged, or dies, any withheld funds will be remitted to the court. The form includes a "Certificate of Mailing," which confirms that a copy of the order has been served on the prisoner by personal service at sentencing or by first-class mail addressed to the institution/facility's last-known address. The form also provides instructions to send a copy of the order to the Michigan Department of Corrections' Court Order Unit by first-class mail or email. Approved, SCAO.
