L42 - ORDER DESIGNATING PROBATE REFEREE. This form is used to issue an order in probate cases in the Superior Court of California, County of Orange. The purpose of this form is to designate a probate referee for a particular case involving the estate of a minor, conservatee, or decedent. The probate referee's role is to appraise the property of the estate, and if necessary, re-appraise the estate property for the purpose of potential sale. If the estate pertains to a decedent who passed away before the repeal of the California Inheritance Tax, the probate referee is also assigned the task of determining and reporting any inheritance tax payable to the State of California due to the decedent's death.
