Description

EJ-147 - APPLICATION AND ORDER TO REQUIRE EXAMINATION AFTER SUBMISSION OF FINANCIAL STATEMENT—CONSUMER DEBT. This form is used in California by a judgment creditor to request a court-ordered examination of a judgment debtor even after the debtor has submitted a financial statement claiming that their income and assets are exempt from enforcement. If the creditor files a motion to require examination and the court finds good cause, this form allows the court to order the debtor to appear in person to provide financial information. This helps the creditor confirm the debtor’s claimed exemptions and obtain details that could assist in enforcing the judgment. The order must be served to the debtor at least 30 days before the examination date, allowing the creditor to proceed if exemptions do not apply. Form Adopted for Mandatory Use Judicial Council of California. Code of Civil Procedure, §§ 708.110, 708.111, 708.170. www.FormsWorkflow.com
