Description

PCT/IPEA/407, NOTIFICATION THAT DEMAND CONSIDERED NOT TO HAVE BEEN SUBMITTED (PCT Rules 54.4, 54bis.1, 55.2(d) and 61.1(b), second sentence). This form is a notification issued by the International Preliminary Examining Authority (IPEA) when a demand for international preliminary examination is considered not to have been submitted under PCT Rules 54.4, 54bis.1, 55.2(d) and 61.1(b), second sentence. A demand for international preliminary examination is a request made by the applicant under PCT Article 31 to have a preliminary examination conducted on the international application to assess the potential patentability of the invention. PCT Rule 54.4 requires that the demand be filed with the receiving Office within a certain time period, and failure to comply with this requirement may result in the demand being considered not to have been submitted. PCT/IPEA/407 is a notification to the applicant that the demand for international preliminary examination has been considered not to have been submitted. The notification may provide information on the reasons for the decision, such as failure to meet the time period requirement, and any options available to the applicant, such as a request for restoration of the right to file the demand. www.FormsWorkflow.com
