Description

PCT/IPEA/409, INTERNATIONAL PRELIMINARY REPORT ON PATENTABILITY (Chapter II of the Patent Cooperation Treaty) (PCT Article 36 and Rule 70). This form is used in the international patent application process under the Patent Cooperation Treaty (PCT) and by the International Preliminary Examining Authority (IPEA) to provide the applicant with a report on the patentability of the invention claimed in the application. Chapter II of the PCT provides for an optional international preliminary examination, which can be requested by the applicant. If a request for international preliminary examination is made, the IPEA will conduct a review of the application to assess the patentability of the invention claimed. Once the review is complete, the IPEA will use the PCT/IPEA/409 form to communicate the findings of the examination to the applicant. The report will include an opinion on whether the claimed invention is novel, involves an inventive step, and is industrially applicable, as well as any observations on other relevant issues such as the clarity of the claims or the sufficiency of the disclosure. The report may also include a written opinion on patentability, which assesses the chances of the invention being granted a patent in the jurisdictions in which the applicant seeks protection. The applicant may respond to the report using the PCT/IPEA/409 form, providing comments or arguments in support of the patentability of the invention. If necessary, the applicant may also file amendments to the claims or other parts of the application in response to the report.
